Designate an establishment or appoint a legal representative for electronic evidence
Service providers must designate an addressee to receive orders concerning the disclosure and preservation of electronic evidence. INotifications will be accepted once the system has been taken into use.

Notifications cannot be submitted yet
You cannot yet select the Finnish Transport and Communications Agency Traficom as the recipient of a notification in the European Commission’s notification service. Notifications will be accepted once the system has been taken into use.
What is this about?
Electronic evidence is information in electronic form that authorities may need when investigating criminal offences and in court proceedings. The information may be held by a service provider operating in another Member State of the European Union.
The European Union’s common procedure allows authorities investigating criminal offences to request electronic evidence directly from service providers in different Member States.
For this reason, service providers must designate an addressee to receive orders concerning the disclosure and preservation of electronic evidence. This addressee is either a designated establishment or a legal representative.
Traficom acts as the central authority in Finland. Traficom reviews the notification if the designated establishment is established in Finland or the legal representative resides in Finland.
Does the notification obligation apply to your organisation?
The notification obligation may apply to your organisation if it provides one or more of the following services in the European Union:
- electronic communications services, such as messaging, video, voice call or broadband services
- domain name or internet protocol (IP) numbering services, such as domain name systems and broker services
- technical internet infrastructure services
- communication, storage or data processing services, such as online platforms, cloud services and web hosting services
- online games that allow users to communicate or store data.
The notification obligation does not apply to financial services.
It also does not apply to a service provider that is established in only one Member State and offers services exclusively in that Member State
Choose a designated establishment or legal representative
If your organisation is established:
- in the European Union, designate at least one designated establishment
- outside the European Union, appoint a legal representative.
The designated establishment or legal representative receives orders concerning the disclosure and preservation of electronic evidence.
How to submit a notification
- Step 1
Create a personal EU Login account
You need a personal EU Login account to use the European Commission’s notification service.
Create an account before you start completing the notification.
- Step 2
Submit the notification in the European Commission service
Sign in to the European Commission’s Notification Form for Service Providers using your EU Login account.
Use the service to declare your organisation’s designated establishment or legal representative.
You cannot yet submit a notification addressed to Traficom. Notifications will be accepted once the system has been taken into use.
- Step 3
Wait for the notification to be reviewed
The notification is reviewed by the central authority of the Member State where the designated establishment is established.
Traficom reviews the notification if the designated establishment is established in Finland.
If information is missing from the notification, Traficom will contact the person who submitted it.
- Step 4
Connect to the European Union’s common information system
Once Traficom has approved the notification, the notification details will be stored in the European Union’s common database.
Traficom will then contact your organisation and provide instructions on connecting to the common information system.
You can use the system either:
- via the e-Evidence Portal Web interface, or
- through a system interface (API).
If you use the web interface, your organisation must appoint an access rights administrator. They grant access rights to the people who process electronic evidence.
System users must have a Finnish personal identity code and a means of electronic identification.
- Step 5
Receive and process orders in the system
Once your organisation has connected to the system, it can receive orders concerning electronic evidence from authorities in other European Union Member States.
Your organisation also uses the same system to produce electronic evidence.
Change information or withdraw a notification
Change information about your organisation or its designated establishment in the European Commission’s Notification Form for Service Providers.
Update the information, for example, when:
- your organisation’s ownership structure changes
- the services provided by your organisation change
- the details of the designated establishment or legal representative change.
You can also withdraw the notification in the same service.
